1. ANNOUNCEMENT

On behalf of the Committee, the Chairman wished to record sincere condolences at the sad death of Councillor Jean Kenrick. 

2. DECLARATIONS OF INTEREST

Cllr Price declared a personal interest in Item 3 on the agenda, (Statement of Licensing Policy) as the secretary of premises holding a Club Premises Certificate.

3. MINUTES OF THE MEETING HELD ON 29th JULY 2010

Resolved: That the minutes of the meeting held on 29th July 2010, be signed by the Chairman as a correct record.

4. STATEMENT OF LICENSING POLICY

The Commitee considered the revised statement of licensing policy, it noted that consultation had taken place until the 22nd October 2010. Comments received had been circulated with the agenda and Mrs Davies (Prinicipal Solicitor- Licensing) explained that a number of minor amendments had been made to the Statement of Licensing Policy to meet the issues raised.

Members noted that the Council as Licensing Authority, was required to produce a policy every three years and that if approved the revised policy would be considered by the Executive at its meeting on the 17th November and Council on the 24th November.

Resolved: That the Executive be recommended to consider the Statement of Licensing Policy for submission and final approval by the Council.

5. HORSE DRAWN HACKNEY CARRIAGE LICENSING POLICY

The Committee considered the recommendation of the Public Protection Sub-Committee regarding a proposed policy resulting from the Sub-Committee of licensing conditions for horse drawn hackney carriages.

Resolved: To recommend the policy to the Executive for approval.

6. DELEGATIONS UNDER THE GAMBLING ACT 2005

The Committee consider delegating the power to revoke licences and permits issued under the Gambling Act 2005 for the non-payment of annual fees.

The Committee noted that Section 193 of the Gambling Act 2005 allowed such revocations.

Resolved:

1. That the Council be recommended to delegate the power to revoke licences and permits under the Gambling Act 2005 for the non-payment of annual fees to the Head of Legal and Democratic Services.

2. That the Head of Legal and Democratic Services exercise this role after consultation with the Chairman or in his absence the Vice-Chairman of the Licensing Committee.

7. LICENSING UPDATE

The Committee considered an update on Licensing issues from Mrs S Davies (Principal Solicitor- Licensing). It was noted that since 1st April 2010, the licensing service had processed 47 applications for new premises licences, 17 variations, 89 transfers, 152 variations of DPS, 17 reviews, 107 temporary event notices and 187 personal licence applications.

Information regarding the additional mandatory licensing conditions and proposed further changes to the Licensing Act 2003 was also outlined to the Committee

Resolved: That the presentation be noted.

8. LICENSING ENFORCEMENT UPDATE

The Committe received an update from Mr Mr M Marshall (Licensing, Health and Safety Enforcement Officer) on the enforcement activities under the Licensing Act 2003. The presentation outlined the various enforcement activities undertaken and the alternative options used for ensuring compliance

Resolved: That the update be noted
